PRICES: Prices are based on current market conditions and are subject to change without notice. All prices are for established nurserymen only and cancel all previous prices offered by us. All prices F.O.B. McMinnville, TN
TERMS: For new customers, a 50% non-refundabe deposit with balance due upon delivery. Eastablished customers, 50% down with balance 30 days after date of invoice. Deposits are non-refundable if order has started being or has been dug. Interest will be charged at the rate of 1.50 percent per month (18 percent per year) on all past due accounts. Invoices that are past due 120 days will be turned over to collections per our decision.
GUARANTEE: We give no warranty, expressed or implied, as to the like, description, quality, productiveness, or any other matter of any nursery stock that we sell. It is mutually agreed that our total liability for any error, should stock prove untrue to name as labeled, shall be limited upon satisfactory proof to our replacing tree or refunding the purchase price. All order are accepted on the condition that they shall be void is stock is damaged by conditions beyond our control.
CLAIMS: Claims for any cause must be made promptly upon receipt of shipment. Any stock rejected must be reported immediately and held for advice from us as to disposition, but in no case should be returned to us without prior approval. We will gladly entertain such reports and make satisfactory adjustments when claims are definitely established. We shall in no case be liable for any sum greater than the amount orginally received for said nursery stock and will not entertain claims after stock has been accepted.
SHIPPING: We ship Oct 15th to Apr 20th. Orders are ship Motor Freight, UPS, Tractor Trailer, or Straight Trucks. If you prefer to pick-up your order, remember to bring a tarp. We are not liable to damage during transit. Customer has responsibility of providing equipment and manpower for unloading trucks. All boxes and packing materials are charged to customer at our cost.
CONDITIONS OF SALE: The parties hereto agree that any dispute arising our of the sale of these goods shall be arbitrated exclusively in the chancery court for Warren County, Tennessee and the state of Tennessee shall be the forum for any and all litigation that may arise from any sale of goods by the seller. Either party not prevailing such action shall be liable to the prevailing party for reasonable attorney fees.
CANCELLATIONS: Orders may not be canceled without the written consent of Bush Gardens Nursery.
AGREEMENT OF SALE: Buyer's acceptance of goods constitutes acceptance of these Terms and Conditions.
